ROOTS & WINGS YOGA WELLNESS RELEASE OF LIABILITY

Release of Liability and Agreement to Indemnify (“Agreement”)

The undersigned in consideration of the services provided by Roots & Wings Yoga Wellness, LLC (referred to as “RAW Yoga”) and Opt2Liv LLC (referred to as “OPT2LIV”) agrees as follows:

In consideration of the undersigned participation in a RAW Yoga / OPT2LIV class, retreat and associated events and activities (collectively referred to as “class/event”) and the services of RAW Yoga and OPT2LIV, its teacher, agents, owners, volunteers, participants, contractors, sponsors, and all other persons or entities acting in any capacity on its behalf, as well as its successor and assigns, Participant, on behalf of his/her self, spouse, children, parents, heirs, and assigned personal representative and estate (collectively referred to as “Participant”), hereby agree to release and discharge RAW Yoga as follows:

1. Assumption of Risks: The Participant voluntarily assumes all risks that may be connected with his or her receipt of the Services from RAW Yoga and any and all activities provided during class/event. Participant acknowledges that he/she is voluntarily participating in all activities with knowledge of these risks. The term "Released Parties" includes RAW Yoga, OPT2LIV and its teacher, members, officers, owners, employees, agents, representatives, affiliates, and/or any other person or entity associated in any way with the class/event.

2. Release: Participant does hereby release and forever discharge RAW Yoga and Released Parties from any and all liability, claims, and causes in action, which arise or may hereafter arise or are in any way connected to Participant’s involvement in a class/event. Participant understands that this Agreement discharges RAW Yoga, OPT2LIV and Released Parties from any liability or claim that the Participant may have against RAW Yoga and Released Parties with respect to any bodily injury, personal injury, illness, death, or property damage that may result form Participant involvement in a class/event, whether caused by the negligence of RAW Yoga, OPT2LIV or otherwise. Participant also understands that RAW Yoga does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness.

Participant understands and acknowledges that the activities in which Participant will voluntarily engage in class/event bear certain known and unknown inherent Risks that contribute to the unique character of these actives, and that RAW Yoga cannot eliminate, alter, or control these inherent risks.

3. Indemnification: The Participant agrees to reimburse and be responsible for (defend, indemnify and hold harmless) the Released Parties from and against all claims, damages, injuries. losses, actions, suits, proceedings, product or strict liability actions, wrongful death actions, expenses, and attorney fees that the undersigned, anyone on undersigned’s behalf (including but not limited to heirs, representatives or next of kin) or any third party have or might have for any fatal injuries, injury, claimed injury, or property damage arising out of or relating to the participants participation in class/event including, but not limited to, any claim that the act or omission complained of was caused in whole or in part by the strict liability or negligence in any form of any of the Released Parties.

4. Customer COVID-19 Representation: Participant will not attend retreat if he/she has been exposed to COVID-19 5 days prior to or during class/event. 

5. Acknowledgment and Assumption of COVID-19 Risks: In addition to the risks listed in the “Assumption of Risks” section above, COVID-19 presents unique health and safety risks and dangers, known and unknown, inherent and otherwise, that cannot be eliminated and which can cause injury, illness, paralysis or death to participant, the Participant’s family members and other third parties. Some, but by no means all, of the risks presented include: (i) COVID-19 is highly contagious; (ii) individuals frequently do not develop COVID-19 symptoms until after they are contagious; (iii) exposed individuals may have more serious symptoms due to other known and unknown medical conditions; (iv) those involved RAW Yoga and OPT2LIV failure to take proper actions to prevent or minimize exposure and/or failure to have and/or use proper protective equipment; and (vi) the acts, omissions and negligence of the Released Parties. The undersigned accepts and acknowledges the undersigned is voluntarily participating in class/event even with knowledge and appreciation of these risks.

6. Medical Care: Participant does hereby release and forever discharge RAW Yoga, OPT2LIV and Released Parties from any liability, claims, and causes in action that arise or may hereafter arise on account of any forest aid, treatment, or services rendered or not rendered in connection with the Participant’s involvement in a class/event.

7. Governing Law and Venue: This Agreement is governed by the laws of the State of Indiana. Any litigation between the parties relating to this Agreement shall be filed and litigated only in the Indiana Commercial Court located in Marion County or if such Court no longer exists, in a federal or state court located in Hamilton County, Indiana. If one or more portions of this document are found to be unenforceable, the remainder of the document will remain enforceable.

8. Photographic Release: Participant does hereby grant and covey unto RAW Yoga and OPT2LIV all rights, title and interest in any and all photographic images, video and audio recordings made by RAW Yoga during class/event, including but not limited to royalties, proceeds, or other benefits derived. Participant authorizes RAW Yoga and OPT2LIV to use such images ,words, and likenesses for marketing, on website, in brochures, social media or other writing for any other legitimate purpose.

CANCELATION POLICY

Classes, workshops, events, trainings and retreats are non-refundable. If participant can not attend class/event for any reason, participant will notify RAW Yoga and OPT2LIV as soon as possible. If a participant can not attend class/event, credit will be given for a future class/event. 

*By completing this form, participant agrees to this liability of release.
